EpiRecipe is a portal site showcasing top chefs' signature dishes and delicious dishes made with seasonal ingredients, allowing gourmets to enjoy authentic flavors. In addition to recipes, we also introduce the featured
chefs' restaurants, teach them how to use delicious seasonal ingredients, and list the chefs' seasonally recommended menu items.
Cooking enthusiasts can not only try out the chefs' special recipes in their own kitchens, but also post their own adaptations.

[Article 1: About these Terms of Use]

  1. The "EpiRecipe Terms of Use" (hereinafter referred to as "these Terms of Use") stipulate the terms of use for all services (hereinafter referred to as "these Services") provided by NAVYPOOL Corporation (hereinafter referred to as "our company") on our website and application (hereinafter referred to as "this site"). By using this Service, you are deemed to have agreed to these Terms of Use
  2. The Company has established individual terms and guidelines (hereinafter referred to as "Individual Terms") for each individual service. Regardless of their name, Individual Terms also constitute part of these Terms of Use (hereinafter, these Terms of Use and Individual Terms are collectively referred to as the "Terms of Use", and when referring to the part of these Terms of Use that does not include Individual Terms, it is referred to as the "EpiRecipe Terms of Use"). Please note that for Individual Services, in addition to the EpiRecipe Terms of Use, the Individual Terms established for that Individual Service also apply, so please also check the contents of those Individual Terms
  3. In the event of a discrepancy between the provisions of the EpiRecipe Terms of Use and the provisions of the individual terms, the provisions of the individual terms shall take precedence
  4. If we determine that there is a reasonable reason, we may change these Terms of Use at any time at our discretion without obtaining the prior consent of the user
  5. The revised Terms of Use will take effect from the time they are displayed on this website, unless otherwise specified by our company. Furthermore, if you use the Service after the changes to these Terms of Use take effect, you will be deemed to have agreed to the revised Terms of Use
  6. If these Terms of Use are newly established or amended, the Terms of Use after such establishment or amendment will apply to actions taken by users prior to the establishment or amendment of such terms
  7. Even if any provision of these Terms of Use is found to be invalid, in whole or in part, under law, the remaining provisions of these Terms of Use and the remaining provisions of these Terms of Use shall remain valid. Even if any part of these Terms of Use is found to be invalid or revoked with respect to a particular user, these Terms of Use shall remain valid with respect to other users
  8. If we do not exercise or enforce any right under these Terms of Use, it will not constitute a waiver of that right

[Article 2 Definition]

The meanings of the terms used in these Terms of Use shall be as set forth in the following items

  1. "User" refers to anyone who uses the Service, regardless of whether they are registered as a user or not
  2. "Registered User" means a person who completes the user registration procedure pursuant to Article 3, Paragraph 2 and uses the Service (including not only free features but also services provided through paid features)
  3. "User registration" means registering on our server as an EpiRecipe user
  4. "Password" means a string of letters and numbers that a Registrant registers during the registration process or changes after registration, in order to identify the Registrant
  5. "Registration Information" refers to information registered by a Registrant during the registration process, such as nickname, email address, password, postal code, date of birth, and gender
  6. "Reported Information" refers to information that a registrant reports to us, including registration information, address, name, telephone number, occupation, bank account number, credit card number, etc
  7. "Acquired information" refers to all information about users that we acquire, including registration information, notification information, the user's IP address, usage status, history, location information, device used, and the fact that credit card payment was not possible
  8. "Personal information" means information that can identify a specific user (including information that can be easily matched with other information and thereby used to identify a specific user)
  9. "Information about user attributes" refers to acquired information excluding personal information, such as postal code, gender, occupation, age, services used or products purchased, pages or advertisements viewed, time of use, method of use, and usage environment

[Article 3 User Registration]

  1. This service can be used without user registration, but some services require user registration
  2. A user who wishes to register as a user (hereinafter referred to as "Applicant") must agree to these Terms of Use and follow the registration procedures specified by our company
  3. Our company will conduct the necessary screening of the application details entered in accordance with the procedure set forth in the preceding paragraph, and if we approve the applicant's user registration, we will register the application details as registration information and send a URL to the email address entered when applying, which will serve as our company's indication of approval.However, if, as a result of screening the application details, we find that the user registration falls under any of the following, we may, at our discretion, not approve the user registration
    • If the applicant has previously been subject to disciplinary action as set forth in Article 16, Paragraph 1 by the Company for violating these Terms of Use, or if the applicant falls under or is likely to fall under any of the items in Article 15
    • Any other reason that the Company deems inappropriate
  4. In addition to the preceding paragraph, the Company may, at its discretion, cancel the user registration if it determines that any of the following items apply to the application or registration information of the applicant or registrant, whether before or after user registration
    • If the applicant or registrant does not exist
    • If the applicant or registrant does not have an email address that can be used to send and receive emails
    • If, at the time of application, you have received or have received a disposition specified in Article 16, Paragraph 1, or if you fall under or are likely to fall under any of the items in Article 15
    • If there is any intentional false statement in the application or registration information
    • If the applicant or registrant is a minor, an adult ward, a person under curatorship, or a person under assistance, and the registration procedure is not carried out by an adult guardian, or the consent of the legal representative, curator, or assistant is not obtained at the time of the registration procedure
    • If the Company otherwise determines that the Applicant's or Registrant's user registration is inappropriate

[Article 4: Paid Services]

If you use any of the paid services provided by our company as paid features of this service, you will be subject to the separately specified terms of use for the paid services

[Article 5: Management of email addresses and passwords]

  1. Registrants are responsible for managing their own email addresses and passwords, and the Company shall not be liable for any disadvantages or damages suffered by Registrants due to inaccurate or false registration information
  2. If we confirm through a prescribed method that the email address and password entered at the time of login match the registered email address and password, we will consider the login to be a genuine login by a registered person and use by that registered person

[Article 6: Handling of Personal Information, etc.]

  1. The Company will handle the personal information it acquires appropriately in accordance with the "Personal Information Protection Policy" and "Handling of Personal Information" separately established
  2. When using this service, in addition to the matters stipulated in the "Privacy Policy" and "Handling of Personal Information," users agree to the display of nicknames and icon photos on this site so that users of this service can recognize each other
  3. Our company will use the acquired information within the scope of the following purposes
    • We may use information about user attributes to improve convenience, such as by customizing the advertisements and content that users see on this site for each registered user
    • We may use information about user attributes to make the content of our services and advertisements more suitable for users, to enhance and improve them, to consider new services, and to select subjects for surveys
    • We may use this information to analyze user attributes and extract subjects for analytical surveys in order to analyze what kind of advertisements, information, services, etc. would be effective for advertisers, information providers, service providers, etc. to post or provide the results of that analysis. However, no information that could identify an individual will be included in the analysis results
    • In addition to registration information, we may use acquired information to allow registered users to view or modify their nickname, email address, and password, and to view usage status
    • We may use registered information to notify registered users about services, send prizes or products, or contact them as necessary
    • In order to verify the identity of the registrant, in addition to the notification information, we may use information such as the delivery status of certified mail
    • In order to bill registrants for their usage fees, we may use registered information such as the services they have used, the products they have purchased, the amount of the invoice received from our partners, their name, address, bank account number, and credit card number
    • We may use the information provided to make payments to you
    • In order to allow registrants to enter data easily, we may display the registration information on the entry screen or transfer it to other services, etc. based on the registrant's instructions
    • Nicknames may be displayed on this service to help you identify which registered users are posting or creating pages
    • We may use the collected information to deny use to anyone who violates these Terms of Use, such as by delaying payment of fees or causing damage to other registrants or third parties, or who attempts to use the service for fraudulent or improper purposes
    • In order to respond to inquiries from registrants, we may use information on user attributes such as the content of the inquiry and information on usage fees, in addition to the notification information
  4. We may entrust the handling of acquired information to a third party to the extent necessary to carry out the purposes of use set forth in the preceding paragraph
  5. We will not disclose or provide personal information to third parties unless we have notified the registrant of the recipient of the personal information and the purpose of its use and obtained their consent
  6. Notwithstanding the provisions of the preceding paragraph, the Company may disclose or provide personal information in accordance with the following items
    • In the event of a compulsory disposition based on Article 218 of the Code of Criminal Procedure (seizure, search, and inspection by warrant) or other provisions of the same Act, personal information may be disclosed or provided to the extent specified by the disposition
    • If the requirements for a disclosure request pursuant to Article 4 of the Act on the Limitation of Liability for Damages of Specified Telecommunications Service Providers and the Right to Disclosure of Sent Information (Requests for Disclosure of Sender Information, etc.) are met, we may disclose and provide personal information within the scope of the disclosure request
    • If we determine that it is necessary to protect life, body, or property, we may disclose or provide personal information to the extent necessary for such protection
    • In other cases stipulated by law, when we determine that disclosure or provision is necessary, we may disclose or provide personal information to the extent necessary

[Article 7: Changes to registered information, cancellation of user registration, etc.]

  1. If there is any change in the registered information, the registrant must promptly notify the Company in accordance with the procedures specified by the Company. If such notification is not made, the Company will treat the registered information as if it has not changed
  2. If a registrant fails to notify us of any changes to their registered information, our company will not be held liable for any delays, non-delivery, or failure to provide notices or other communications
  3. Registrants can cancel their user registration by following the cancellation procedure specified by our company

[Article 8: Prohibition of Transfer, etc.]

  1. Registrants may not transfer their rights related to the Service to a third party, pledge them, or use them as security
  2. The status of a registered user is personal and cannot be sold, transferred, or inherited

[Article 9: Contact or Notification]

  1. If we determine that it is necessary to contact or notify a registrant, we will contact or notify them by email to the registered email address
  2. Unless otherwise specified in these Terms of Use, users should contact the Company through the inquiry form. The Company does not accept contact by phone or in person

[Article 10: Suspension of the provision of the Service]

  1. If any of the following events occur, we may temporarily suspend the provision of all or part of the Service without prior notice to users
    • When regular maintenance and inspection of communication equipment, etc., required to provide the Service is carried out or when emergency inspection is carried out
    • If the Service cannot be provided due to a fire, power outage, etc
    • If the provision of the Service becomes impossible due to a natural disaster such as an earthquake, eruption, flood, or tsunami
    • When the provision of the Service becomes impossible due to war, unrest, riots, civil unrest, labor disputes, etc
    • Any other operational or technical reasons that the Company deems necessary to temporarily suspend the provision of the Service
  2. If the Company deems it necessary, the Company may change the content of the Service or suspend or discontinue the provision of the Service at any time without prior notice
  3. Even if there is a delay or interruption in the provision of all or part of the Service due to any of the items in paragraph 1 or other reasons, the Company shall not be liable for any damages suffered by users or third parties as a result thereof, except as otherwise provided in these Terms of Use
  4. Unless otherwise specified in these Terms of Use, we shall not be liable to users in any way even if we change the content of this service or suspend or discontinue the provision of this service

[Article 11: Improvement of the usage environment]

  1. The User shall prepare, at its own expense and responsibility, all communications equipment, software, and other associated equipment required to use the Service, and keep them available for use. In addition, when using the Service, the User shall connect to the Internet via a telecommunications service or telecommunications line of its own choosing, at its own expense and responsibility
  2. Users shall refer to information provided by relevant government agencies and other organizations and maintain security measures, such as preventing computer virus infection, unauthorized access, and information leaks, in accordance with their own usage environment
  3. The Company has no involvement in or responsibility for the user's usage environment

[Article 12: Principle of Self-Responsibility]

  1. Users shall use the Service at their own risk and shall be responsible for all actions taken using the Service and the results thereof
  2. If a user causes damage or disadvantage to other users, other third parties, or our company when using this service, the user shall resolve the same at their own responsibility and expense

[Article 13 Intellectual Property Rights, etc.]

  1. The User shall be deemed to have granted to the Company or a party designated by the Company the right (including the right to sublicense) to freely use (including copying, publishing, transmitting, distributing, transferring, lending, translating, and adapting) the Content transmitted (transmitted) by the User on a non-exclusive basis and without any restrictions, both in Japan and overseas, without payment of compensation, for the duration of the copyright and all other rights relating to the Content, and the User hereby acknowledges this in advance. Even if the User holds moral rights relating to the Content, the User shall not exercise such rights against the Company or a party designated by the Company
  2. Any and all claims or demands arising from or relating to content sent (transmitted) by the user, the user's use of the service, connection to the service, violation of the terms and conditions, or infringement of the rights of a third party by the user shall be resolved at the user's own responsibility and expense
  3. If the Company incurs expenses or pays compensation in connection with responding to the complaints or claims set forth in the preceding paragraph, such expenses and compensation, as well as any attorney's fees paid by the Company, shall be borne by the User in question, and the Company may request payment of the total amount thereof from the User in question
  4. Users acknowledge that the Company has no obligation to store any content sent (transmitted) by them, and shall back up any necessary content as appropriate
  5. The Company may view content sent (transmitted) by users as necessary for operational purposes, and if the Company determines that the content violates the Terms of Use, the Company may make all or part of the content private or delete it without prior notice to the user

[Article 14: Company Property Rights]

  1. With the exception of content and information sent (transmitted) by users, all property rights to the content and information contained in this service belong to our company
  2. The content posted or provided on this service or in advertisements is protected by copyright law, trademark law, design law, etc
  3. The Service and all software used in connection with the Service contain proprietary rights and trade secrets that are protected by laws and regulations regarding intellectual property rights

[Article 15 Prohibited matters]

  1. When using this service, users are prohibited from engaging in the following acts:
    • Any act that infringes or may infringe the intellectual property rights, such as copyrights and trademarks, of our company, other users, or other third parties (hereinafter referred to as "other parties")
    • Any act that infringes or may infringe the property, privacy or portrait rights of others
    • Provision of personal information of specific individuals
    • An act in which one user holds multiple registered user positions, or an act in which multiple people jointly hold the same registered user position
    • Registering as a user on behalf of a person whose registration status has been suspended or revoked
    • Any act of discriminating against or slandering others, or damaging the reputation or credibility of others
    • Altering or deleting any content or information accessible through the Service or the content or information of others
    • Impersonating our company or another person (including tampering with email headers, etc., in order to deceive others)
    • Sending harmful computer programs or making them available for others to receive
    • Pre-election campaigning, election campaigning (including similar activities), or any activity that violates the Public Offices Election Act
    • Sending advertising, promotional or solicitation e-mails or e-mails that are offensive (including e-mails that may be so) to others without their permission, interfering with the reception of e-mails by others, requesting the forwarding of chain e-mails or forwarding e-mails in response to such requests
    • Any act that places a load on the server beyond the normal use of the Service or any act that encourages such load, or any act that interferes with or causes a disruption to the operation and provision of the Service or the use of the Service by other users
    • Distributing information, devices, software, etc. to disable or circumvent the access control functions of servers, etc
    • Reproducing, modifying, reproducing, altering, changing, reverse engineering, disassembling, decompiling, translating or analyzing any of the functions provided by the Service
    • Obtaining registration information of other people without their consent or by fraudulent means (including so-called phishing and similar means)
    • Using all or part of the Service for commercial purposes, regardless of the method of use (including acts aimed at preparing for such use)
    • Use of the Service without following legal procedures such as notification to supervisory authorities or obtaining licenses and permits, or other actions that violate or may violate such laws and regulations
    • Any act that interferes with the operation of the Service, any act that interferes with the exchange or sharing of information initiated by others, any act that causes harm to the Company or others, such as damage to reputation or infringement of property rights
    • Actions that significantly disrupt our business, such as making long phone calls, making excessively similar inquiries, or forcing others to do things that are not obligatory or justified
    • In addition to the above, any act that violates laws and regulations or these Terms of Use, or any act that violates public order and morals (including acts of transmitting or displaying information or graphic images that may encourage or induce violence, or acts of soliciting accomplices for double suicide, etc.)
    • Linking to data that contains any of the acts listed above (including cases where such acts are being performed by others) with the intent of encouraging such acts
    • Any other conduct that the Company deems inappropriate for a user
  2. If a user falls under any of the following categories, the user will not be able to use the Service
    • Organized crime
    • gang members
    • Associate member of a criminal organization
    • Companies related to organized crime
    • Corporate racketeers, social activists, or special intelligence violent groups
    • Other persons who fall under any of the above categories

[Article 16 User Cancellation, etc.]

  1. If the Company determines that a User's actions violate these Terms of Use or that the User falls under any of the persons set forth in Paragraph 2 of the preceding Article, the Company may, at its discretion and without any notice to the User, delete or change any content transmitted (distributed) through the Service, suspend the Service, cancel the User's registration (including suspending the User's status), or deny the User access to the Site
  2. When we take the action set forth in the preceding paragraph, we will notify registered users to the email address they registered in advance, and unregistered users to the email address notified by the user
  3. If the email from our company as set forth in the preceding paragraph does not reach the user due to circumstances on the user's part, the email from our company will be deemed to have reached the user
  4. We will not accept any questions or complaints regarding any actions taken by our company in accordance with the provisions of this Article

[Article 17: Restrictions on Use]

  1. If a user falls under any of the following categories, we may restrict the user's use of the Service without obtaining the user's consent
    • If it is determined that the Registrant's involvement may cause harm to a third party due to a worm-type virus infection, mass email transmission route, etc
    • If you cannot be contacted by phone, email, etc
    • If mail sent to the user is returned to our company
    • In addition to the above, if the Company deems the situation urgent
  2. If a User is unable to use the Service due to the Company's restriction on the User's use of the Service pursuant to the preceding paragraph, and the User suffers damage as a result, the Company shall not be liable in any way

[Article 18 Disclaimer]

  1. We shall not be liable for any damages incurred by users as a result of using this service
  2. If a user causes damage to a third party by using this service, the user shall compensate for such damage at his/her own expense and responsibility
  3. The Company shall not be liable for any damages caused by the inability to use the Service due to any malfunction, error, or failure occurring in the Service
  4. The Service and the content and information on this website are provided as they are available at the time of the service. The Company makes no guarantees whatsoever as to the completeness, accuracy, applicability, usefulness, availability, safety, reliability, etc. of the information provided, texts and other content registered or transmitted (transmitted) by users, and software, etc
  5. The Company may provide information and advice to users as appropriate, but shall not be liable for the results thereof
  6. If data is damaged or lost due to any external factors, the Company shall not be held responsible
  7. If the contract between the user and the company based on these Terms of Use constitutes a consumer contract as defined in Article 2, Paragraph 3 of the Consumer Contract Act (Act No. 61 of 2000), the provisions in these Terms of Use that completely exempt the company from liability shall not apply. If the contract based on these Terms of Use constitutes a consumer contract and the company is liable for damages based on default or tort, the company shall be liable for damages up to the direct and actual damage suffered by the user, except in cases of willful misconduct or gross negligence on the part of the company, and shall not be liable for damages arising from special circumstances (including cases where the occurrence of damage was foreseeable or could have been foreseen)

[Article 19: Services Under Development]

  1. We may provide services under development as part of this Service or as independent services
  2. Users understand that due to the nature of services under development, they may be provided with bugs, defects, malfunctions, and other issues that may prevent the service from functioning properly
  3. If we deem it necessary, we may change the content of any service under development or suspend or discontinue the provision of any service under development at any time without prior notice
  4. We make no guarantees whatsoever regarding the completeness, accuracy, applicability, usefulness, availability, safety, reliability, etc. of the services under development

[Article 20 Governing Law]

These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan

[Article 21 Jurisdiction]

In the event that litigation between a user and our company becomes necessary, the Tokyo District Court shall be the exclusive court of first instance
